The U.S. Federal Government Temporarily Halts Evictions (COVID-19)

The federal government is temporarily halting evictions (COVID19) as announced by the White House on September 1, 2020.

President Trump’s Executive Order is being followed through by the CDC to temporarily halt evictions through the end of 2020 to fight the pandemic.

The tenant must use their best efforts to pay their rent, seek government rental assistance, and are likely to otherwise become homeless, and must otherwise comply with their lease (e.g., no criminal acts, no threatening safety, no property damage).

The tenant will be responsible for rents not paid at some point in the future.

HUD has allocated rental assistance money to local public housing authorities.

Landlords should seek legal/tax advice, communicate with tenants, and seek governmental assistance if needed.

Landlords with federally backed mortgages should seek legal counsel regarding evictions. Some evictions can move forward even under these federal actions (e.g., tenant acts criminally, tenant threatens safety, tenants destroy property).

Tenants should attempt to pay their rent and seek governmental assistance if needed.
