Are Short Sales Good Comparable Sales to Use in Appraisals?

At recent NAR meetings, professionals discussed issues with using short sales as comparable sales.
Because many aspects of the short sale are not public record, an appraiser has a difficult time determining how to adjust the short sale when used as a comparable property.  

Because a short sale is not a simple willing buyer and willing seller transaction, adjustments to the price should be made if used as a comparable sale.

In 2010, REALTOR® members across the country met vastly different market conditions. Some markets saw a boom after the Great Recession; others have continued to be plagued with high unemployment conditions. All markets have been stalled by the tightening of the mortgage market, which has limited potential clients from purchasing a home. Existing home sales declined slightly from 2009 to 2010, to 4.9 million sales from 5.2 million sales. Prices of existing homes remained steady from 2009 to 2010 at $172,900.

As reported in the May 3, 2011 Wall Street Journal; the SC Supreme Court halts judicial foreclosures reminiscent of the 2009 SC Supreme Court ordered judicial foreclosure moratorium designed to help solve the foreclosure crisis.

Recommended Seller Disclosure Procedure

SCR recommends that listing agents always make written seller disclosure a requirement for taking the listing.

In 2009, there was great SC Appeals Court case that sets precedent:  real estate agents cannot be sued by buyers for property condition if there was a seller disclosure RPCDS and the real estate agents were not aware of any misrepresentations.  Also, the real estate agents did not make any representations.  Please see attached.
